Terms & Conditions

These terms govern every order placed on silviaserban.eu. The seller is S.C. Idelier Concept Store S.R.L., Str. Biserica Amzei no. 21-23, Sector 1, Bucharest, J40/4971/2009, CUI RO 25449863.

1. Definitions

Seller – S.C. Idelier Concept Store S.R.L., a Romanian company with its registered office in Bucharest, Str. Biserica Amzei no. 21-23, Sector 1, registered with the Trade Registry under no. J40/4971/2009, holding Tax ID (CUI) RO 25449863.

Buyer – the individual who creates an account on the site and places an order.

Client – the individual who has or obtains access to the Content, through any means of communication provided by S.C. Idelier Concept Store S.R.L., or under an existing agreement between S.C. Idelier Concept Store S.R.L. and that person, requiring the creation and use of a client account.

User – any person registered on the site who, upon completing the account creation process, has given their consent to the Terms and Conditions section.

Account – the section of the site consisting of an email address and password, allowing the Buyer to place an order, and containing information about the Client/Buyer and their purchase history on the site (orders, invoices, warranties, etc.).

Site – the domain www.silviaserban.eu and its subdomains.

Order – an electronic document serving as a form of communication between the Seller and the Buyer, through which the Buyer conveys to the Seller, via the site, their intention to purchase products from the site.

Contract – the distance contract between the Seller and the Buyer, not requiring the simultaneous physical presence of both parties.

Content – all information on the site that can be viewed or accessed using electronic devices; the content of any email sent to the Buyer by the Seller through electronic means and/or any other available means of communication; any information communicated to the Buyer, by any means, by an employee/collaborator of the Seller, in accordance with the contact details provided.

Newsletter – periodic information sent exclusively by electronic means (email, SMS, WhatsApp) regarding the Seller's products and/or promotions during a given period, without any commitment on the Seller's part regarding the information it contains.

2. Contract Documents

2.1. By placing an order on the site, the Buyer agrees to the form of communication (phone or email) through which the Seller conducts its commercial operations.

2.2. The notification received by the Buyer after placing an order is for informational purposes only and does not constitute acceptance of the order. This notification is sent electronically, by email or by phone.

2.3. For justified reasons, the Seller reserves the right to modify the quantity of products in an order, with the obligation to notify the Buyer at the email address or phone number provided when the order was placed, and to refund the amount paid.

2.4. The Contract is deemed concluded between the Seller and the Buyer upon the Buyer's receipt, by email and/or SMS, of the shipping notification for the order.

3. Online Sales Policy

3.1. Access to an order is permitted to any Client/Buyer.

3.2. Communication with the Seller may take place through direct interaction or via the addresses listed in the "Contact" section of the site. The Seller is free to manage the information received without being required to provide justification.

3.3. In the case of online payments, the Seller cannot be held responsible for any additional cost incurred by the Buyer, including but not limited to currency conversion fees applied by the card-issuing bank where the issuing currency differs from RON. Responsibility in this respect lies exclusively with the Buyer.

3.4. All information used to describe the products available on the site (static/dynamic images, multimedia presentations, etc.) does not constitute a contractual obligation on the Seller's part and is used solely for presentation purposes.

4. Assignment and Subcontracting

The Seller may assign and/or subcontract to a third party services related to order fulfillment, with notice to the Buyer but without requiring the Buyer's consent. The Seller remains liable to the Buyer for all contractual obligations.

5. Intellectual and Industrial Property Rights

5.1. The Content, including but not limited to logos, stylized representations, trademarks, static and dynamic images, text and/or multimedia content presented on the site, is the exclusive property of S.C. Idelier Concept Store S.R.L., with all rights reserved, obtained directly or indirectly (through usage and/or publishing licenses).

5.2. The Client/Buyer is not permitted to copy, distribute, publish, transfer to third parties, modify, alter, use, display, or include any Content in any context other than the original one intended by S.C. Idelier Concept Store S.R.L.

5.3. The Client/Buyer may copy, transfer and/or use the Content only for personal or non-commercial purposes, provided this does not conflict with the provisions of this document.

5.4. Any use of the Content for purposes other than those expressly permitted by this document, or by any applicable usage agreement, is prohibited.

6. Order

6.1. The Client/Buyer may place orders on the site by adding the desired products to the shopping cart and completing the order through one of the expressly indicated payment methods. Once added to the cart, a product is available for purchase only if in stock. Adding a product to the cart, without completing the order, does not constitute order registration or automatic reservation of the product.

6.2. By completing the order, the Buyer confirms that all data provided for the purchase process is correct, complete, and accurate at the time the order is placed.

6.3. By completing the order, the Buyer agrees that the Seller may contact them by any means available to or agreed upon by the Seller, whenever necessary.

6.4. The Seller may cancel an order placed by the Buyer, following prior notice to the Buyer, with no further obligation between the parties and without either party being entitled to claim damages, in the following cases:

— the Buyer's card-issuing bank does not accept the transaction, in the case of online payment;

— the transaction is invalidated by the card processor engaged by S.C. Idelier Concept Store S.R.L., in the case of online payment;

— the data provided by the Client/Buyer on the site is incomplete and/or incorrect.

6.5. The Buyer has the right to withdraw from the Contract or return a product within 14 calendar days, without giving any reason and without bearing any costs other than the direct cost of returning the products. This does not apply to made-to-order (tailor-made) pieces, produced to the Buyer's specifications or clearly personalised, which cannot be returned or exchanged, in accordance with art. 16(c) of Government Emergency Ordinance no. 34/2014.

Accordingly, under Government Emergency Ordinance no. 34/2014, the period for returning a product or withdrawing from a service expires 14 days from:

— the day the Buyer takes physical possession of the last good – where multiple products are ordered in a single order and delivered separately;

— the day the Buyer takes physical possession of the last good or piece – in the case of a product consisting of multiple pieces.

6.6. Should the Buyer decide to withdraw from the Contract, they must notify their intention by email at contact@silviaserban.eu.

6.7. If the Client/Buyer requests withdrawal within the legal withdrawal period, they must return any gift that accompanied the product. If the order has been paid for, the Seller will refund the amount within 14 (fourteen) days of being informed of the withdrawal decision. The amount will be refunded to the account from which the payment was made.

6.8. The Seller may delay the refund until the goods sold are received back.

6.9. If a product ordered by the Buyer cannot be delivered, the Seller will inform the Client/Buyer of this and will refund the value of the product to the Buyer's account within 7 (seven) days of becoming aware of this, or of the Buyer expressly stating their intention to terminate the Contract.

7. Confidentiality

7.1. S.C. Idelier Concept Store S.R.L. will keep confidential any information provided by Clients. Such information may only be disclosed under the conditions set out in this document.

7.2. No public statement, promotion, press release, or other form of disclosure to third parties regarding the order/Contract shall be made by the Buyer/Client without the Seller's prior written consent.

8. Marketing Communications

8.1. Newsletters from S.C. Idelier Concept Store S.R.L. are sent through specialized partners engaged by S.C. Idelier Concept Store S.R.L., ensuring the confidentiality and security of information.

8.2. The Client may change their consent to the Seller at any time by:

— contacting S.C. Idelier Concept Store S.R.L. directly;

— changing the settings in their client account;

— using the unsubscribe link included in commercial messages received from the Seller.

8.3. Unsubscribing from newsletters does not withdraw the Client's acceptance of this document.

9. Invoicing – Payment

9.1. Product prices displayed on www.silviaserban.eu include VAT, in accordance with applicable legislation.

9.2. The price, payment method, and payment terms are specified in each order. The Seller will issue an invoice to the Buyer for the delivered products, and the Buyer must provide all information required for issuing the invoice in accordance with applicable legislation.

9.3. The Seller will send the Buyer the invoice for the order, covering products sold by S.C. Idelier Concept Store S.R.L. and any other related payments, exclusively in electronic format, either through the Buyer's account or by email, to the address provided in their account.

9.4. To ensure accurate invoice communication, the Buyer is responsible for keeping their account details up to date and for accessing the information and documents related to each order in their account.

9.5. Through this method of communication, the Buyer, by accessing their account, will have a record of invoices issued by S.C. Idelier Concept Store S.R.L. and may save and archive them at any time, in any manner they choose.

9.6. By placing an order, the Buyer agrees to receive invoices in electronic format, either through their account or by email, at the address provided in their account.

9.7. If this information is unavailable in the user's account for more than 48 hours, please notify us at: contact@silviaserban.eu.

9.8. The Client's/User's/Buyer's payment card details will not be accessible to, or stored by, S.C. Idelier Concept Store S.R.L. or the payment processor integrated into the site, but only by the transaction authorization institution or another entity authorized to provide card data storage services, whose identity the Client/User/Buyer will be informed of before entering their data.

Payments are processed exclusively through the Shopify platform. The Shopify payment platform does not store the Buyer's/Client's/User's full credit card number for standard purchases, unless they expressly choose to save their details via the Shop Pay service. The Seller never has access to the full card number — only to the last 4 digits, the expiry date, and the card type. Payment processing complies with the global PCI DSS Level 1 security standard (Payment Card Industry Data Security Standard).

9.9. In certain cases, to maintain transaction security, the Buyer will be asked to authorize payment by re-entering their account password or, on mobile devices that support it, using fingerprint authentication.

9.10. For transaction security reasons, the Client/User/Buyer is advised not to remain logged in on the site and not to enable automatic login on mobile devices. Disclosing the account password is not permitted; a strong password is recommended (e.g., at least eight characters, including uppercase and lowercase letters, numbers, and special characters).

10. Delivery of Products

10.1. The Seller undertakes to deliver products by door-to-door courier to the Buyer.

10.2. The Seller will ensure proper packaging of the products and the transmission of accompanying documents.

10.3. The Seller will deliver products within Romania free of charge; for international deliveries, the Buyer must bear the full cost of delivery and any applicable duties.

11. Warranties

All products sold by S.C. Idelier Concept Store S.R.L. carry warranty conditions in accordance with applicable legislation and the manufacturers' commercial policies.

12. Transfer of Ownership

Ownership of the products transfers upon delivery, after payment has been made by the Buyer, at the location indicated in the order (i.e., upon delivery, by signing the courier's transport receipt).

13. Liability

13.1. The Seller cannot be held liable for any damages of any kind suffered by the Buyer or any third party as a result of the Seller fulfilling its obligations under the order, or for damages arising from the use of the products after delivery, in particular their loss.

13.2. By creating and using the account, the Client/User/Buyer takes responsibility for maintaining the confidentiality of their account credentials (username and password) and for managing access to the account, and, to the extent permitted by law, is responsible for any activity carried out through their account.

13.3. By creating an account and/or using the Content and/or placing orders, the Client/User/Buyer expressly and unambiguously accepts the site's Terms and Conditions in their latest version, as published on the site at the time the account is created, the Content is used, and/or the order is placed.

13.4. After account creation, continued use of the Content constitutes acceptance of any changes made to the site's Terms and Conditions and/or their updated versions.

13.5. The site's Terms and Conditions may be modified at any time by S.C. Idelier Concept Store S.R.L. and are binding on Clients/Users/Buyers from the date they are published on the site. Acceptance of the Terms and Conditions is confirmed by checking the corresponding checkbox on the site and/or by placing an order and/or making an online payment.

14. Force Majeure

14.1. Neither party shall be liable for failure to perform its contractual obligations if such failure, whether total or partial, timely or otherwise, results from a force majeure event. Force majeure is an unforeseeable event, beyond the control of the parties, that cannot be avoided.

14.2. If such an event does not cease within 15 (fifteen) days of its occurrence, either party shall have the right to notify the other of the automatic termination of the Contract, without either party being entitled to claim damages from the other.

15. Governing Law – Jurisdiction

Any dispute between the Seller and the Client/Buyer shall be resolved amicably. If this is not possible, disputes shall be settled by the competent courts in Bucharest, Romania.
